公開シンポジウム「ラファエル・レムキンと日本のジェノサイド条約加入をめぐる課題」（Raphael Lemkin and Challenges Surrounding Japan's Accession to the Genocide Convention.）

今日の国際社会が直面する重大課題の一つに「ジェノサイド（集団殺害）」犯罪がある。一つの民族や人種・宗教・国民的集団を根絶やしにしようとする犯罪に、「ジェノサイド」という名称を与えて概念を精緻化し、1948年の「集団殺害犯罪の防止及び処罰に関する条約（ジェノサイド条約）」採択につなげたのは、ユダヤ系ポーランド人法学者ラファエル・レムキン（1900-1959）である。そのレムキンが、ジェノサイド条約採択後、心臓発作で急逝するまでライフワークとしたのが、同条約の普遍化である。
同条約には、2026年１月現在、アメリカ、ロシア、中国を含む153カ国が加入する一方、日本は、ジェノサイド罪を人道に対する犯罪、戦争犯罪、侵略犯罪とともに対象犯罪とする国際刑事裁判所（ICC）ローマ規程には加入しているにも関わらず、批准していない。なぜ、日本のジェノサイド条約加入は進まないのか。条約の採択とほぼ同時期（1948年12月11日）に署名しながら、批准（1988年11月25日）まで40年を要した米国の事例を検討しつつ、政治的、法的、社会的意味と意義を考える。

One of the critical challenges facing today's international community is the crime of “genocide.” The term "genocide" was coined by Polish-Jewish lawyer Raphael Lemkin (1900-1959). He refined the concept, which ultimately led to the adoption of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, also known as the Genocide Convention. His contributions were instrumental in establishing the term and refining the concept. After the Convention's adoption, universalizing it became Lemkin's life's work until his sudden death from a heart attack.
As of January 2026, 153 countries, including the United States, Russia, and China, are parties to the Convention. While Japan, despite being a party to the Rome Statute of the International Criminal Court (ICC), has not ratified it. Why has Japan not acceded to the Genocide Convention? Examining the case of the United States, which signed the treaty almost simultaneously with its adoption (December 11, 1948) yet took 40 years to ratify it (November 25, 1988), this symposium will consider the political, legal, and social implications and significance of non-accession.

東京大学法学部卒。1982年検事任官。横浜、津、名古屋、仙台、札幌他地検検事、東京高検検事、函館地検検事正などを経て国際連合アジア極東犯罪防止研修所所長、法務省法務総合研究所所長、最高検察庁検事など歴任。名古屋・中京大学法科大学院教授、外務省参与・国際司法協力担当大使なども務めた。2018年国際刑事裁判所（ICC）判事。2024年３月からICC所長。
米国イーロン大学歴史学・法学名誉教授（Professor Emeritus of History & Law at Elon University）
ディヴィッド・クロウェ（David M. Crowe） 氏
チャップマン大学のプレジデンシャル・フェロー・コロンビア大学民族研究協会名誉会長。1990年から2004年までワシントンD.C.にある米国ホロコースト記念博物館教育委員会の委員も務めた。「国民文化の対話への貢献」により、2023年TREBBIA国際賞（プラハ）を受賞。2026年にラファエル・レムキンの評伝『Raphael Lemkin: The Life of a Visionary』を出版予定。同氏の国際刑事法および国際関係の著作としては、Stalin’s Soviet Justice: ‘Show Trials’, War Crimes Trials, and Nuremberg (2019); “Mongolia: Battleground of Eurasian Imperialism,” in The Impact of Russia’s Great War and Revolution, Book I (2019); “The Tokyo and Nuremberg IMT Trials,” in 70 Years On: The International Military Tribunal for the Far East (2019); “Pearl S. 2014年に京都大学大学院法学研究科より博士号取得。京都大学大学院法学研究科助手（2003-2005年）、岡山大学法学部助教授・准教授（2005-2009年）、神戸大学大学院法学研究科准教授・教授（2009-2021年）を経て、2021年10月より現職。主な著書に、『国際裁判の判決効論』（有斐閣、2012年：第46回安達峰一郎記念賞受賞）、共著に『国際法』（有斐閣2017、2022年）他。「ジェノサイド条約：ジェノサイド犯罪の防止と処罰—国際条約は世界を規律するか？」『法学教室』（520）2024年１月ほか、論説、解説、判例研究など多数。
